Nexo Widgets

1.About these terms

These Terms of Service (the "Terms") apply to Nexo Widgets ("Nexo" or "the app"), the Android app with package name com.akustom15.nexo, distributed through Google Play, and to its in-app purchase Nexo Pro. They apply only to this app.

By downloading, installing or using Nexo, you agree to these Terms. If you don't agree, please don't use the app. Your download and purchases on Google Play are also governed by the Google Play Terms of Service.

2.Who provides Nexo

Nexo is developed and sold by an individual developer acting as a trader under European Union and United Kingdom consumer law.

The full postal address and phone number of the trader appear in the developer details of the Nexo listing on Google Play.

In these Terms, "we", "us" and "our" mean AKustom15, and "you" means the person using the app.

3.What Nexo includes

Nexo is a home-screen customization app. It includes:

• Native home-screen widgets that share one style, in categories such as clock, date and calendar, weather, music, battery, devices, alarm, folders, mixed panels, photos and contacts. No KWGT or other apps are needed for them.
• Customization options such as light, dark or system theme, accent colors and adaptive or fixed sizes.
• A wallpaper catalog designed to go with the widgets, included at no cost.

The number of widgets grows over time and is shown on the Google Play listing. Some widgets need optional permissions, such as approximate location for weather, calendar access for events or notification access for music. If you don't grant a permission, only the widget that needs it stops showing data.

The weather and other information shown in the widgets is for general information only, and we can't guarantee that it is always accurate or up to date.

4.Free version and license

Nexo is free to download. A selection of widgets is free and stays free; the free widgets are marked in the app. The rest of the widgets are premium and are unlocked with Nexo Pro.

We give you a personal, non-exclusive, non-transferable and revocable license to install and use the app, and the widgets and wallpapers it contains, on your Android devices. If you buy Nexo Pro, the license also covers the premium widgets on the devices linked to the Google account you used to buy it. The license is for your personal, non-commercial use. You don't acquire ownership of the app or its content.

5.Nexo Pro

Nexo Pro is the only purchase in the app.

The current price is shown in the app and on Google Play, in your local currency, before you confirm the purchase. There are no subscriptions, no automatic renewals and no ads.

How Nexo Pro works

• Verification. To confirm that a purchase is genuine, the app sends the Google Play purchase receipt to our verification server, which checks it with Google and returns a license that unlocks the premium widgets. The receipt doesn't contain your name, email or payment details.
• Renewal. The app renews that license automatically in the background, about once a month. For this, your phone needs an internet connection from time to time. If the license can't be renewed for a long period, the premium widgets may lock until the phone connects again. Your purchase is not lost.
• Restore. Your purchase is linked to your Google account. On a new phone, or after reinstalling, use Restore purchase in the app while signed in with the same account.
• Refunds and cancellations. If a purchase is refunded, cancelled or charged back through Google Play, Nexo Pro is removed and the premium widgets lock again.

6.Refunds and right of withdrawal

All payments are processed by Google Play. Refunds for Nexo Pro are handled under the Google Play refund policies. You can usually request a refund directly from Google Play within 48 hours of the purchase.

After that period, you can still write to us. If Nexo Pro didn't work as described on your phone, we will try to solve it, and where appropriate we will help you get a refund.

Consumers in the EEA and the UK

Nexo Pro is digital content. When you buy it, you ask for it to be supplied straight away, and you acknowledge that you lose the 14-day right of withdrawal once supply has started. Google Play asks for this consent at checkout where the law requires it.

This does not affect your legal rights if the app or Nexo Pro is faulty or not as described.

7.Updates and compatibility

• We update Nexo regularly to add widgets and fixes. We may change, improve or remove features, as long as the app keeps working as described for its main purpose.
• Nexo works with Android launchers that support home-screen widgets. How widgets fit the grid can vary between launchers and phone brands.
• Some phone brands stop apps in the background. On those phones, widgets may update less often unless you allow Nexo to run in the background.
• Widgets depend on Android and on the data sources they use. Changes in Android or in those services may temporarily affect them.

8.Intellectual property

The widget designs, wallpapers, graphics and code in Nexo are the original work of AKustom15 and are protected by copyright. Except for the license in section 4, all rights are reserved.

Names and logos of third-party apps and services that appear in the app, for example in the music widgets, belong to their owners. Their appearance in Nexo doesn't mean that the owners are affiliated with or endorse AKustom15.

9.Acceptable use

You agree not to:

• Extract, copy, share, redistribute, sell or sublicense Nexo's widget designs or wallpapers, or include them in other apps, themes or products.
• Distribute copies of the app, or modify it to unlock premium widgets without buying Nexo Pro.
• Reverse engineer or decompile the app, except where the law expressly allows it.
• Interfere with our verification server or with the other services the app uses.

Copies of the app obtained outside Google Play, or modified copies, are not covered by these Terms and may not work.

10.Third-party services

Nexo relies on services from other companies, including Google Play (distribution and payments), Google Play Integrity (confirming the app is the original), Cloudflare (hosting of our purchase verification server), Google Firebase Cloud Messaging (notifications), Open-Meteo (weather data), GitHub and images.weserv.nl (wallpaper images) and the launcher you use. Those services are governed by their own terms, and we are not responsible for their availability.

11.Privacy

How Nexo uses your data, including the optional permissions and the purchase verification, is explained in its Privacy Policy. Nexo shows no ads, doesn't use analytics and doesn't require an account.

12.Warranty and liability

We work to keep Nexo working well and as described on Google Play. If you are a consumer in the EEA, the UK or another country with similar laws, you have a legal guarantee that the app and Nexo Pro conform to their description. These Terms don't limit that guarantee.

To the extent the law allows, we are not liable for indirect or unforeseeable losses, or for problems caused by your device, your launcher, third-party services, or uses of the app not allowed by these Terms. Where the law allows a limit, our total liability is limited to the amount you paid for Nexo Pro.

Nothing in these Terms limits liability that cannot be limited by law, such as liability for intentional misconduct or gross negligence.

13.Governing law

These Terms are governed by the laws of the Bolivarian Republic of Venezuela. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in the courts of that country.

If you have a problem, please write to us first. Most issues can be solved quickly by email or Telegram.

14.Changes to these terms

We may update these Terms, for example when we add features or when the law changes. The date at the top of this page always shows the version in force. If a change materially affects your rights, we will announce it in the app or on Google Play before it takes effect. Changes don't apply to purchases you made before them.
